Terms of Service

Terms governing your use of jevailab and its AI image tools

1. Agreement to these terms

These Terms of Service ("Terms") form an agreement between you and jevailab governing your access to and use of the jevailab website, account, and image-generation tools (together, the "Service"). By creating an account, purchasing credits, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility and accounts

You must be legally able to enter into a binding agreement and meet the minimum age required by the laws that apply to you. You are responsible for providing accurate account information, keeping your login credentials secure, and for activity carried out through your account. Notify us promptly if you believe your account has been compromised.

3. The service

jevailab provides online tools that use third-party artificial intelligence models to generate still images from text descriptions and published templates. Features, models, templates, limits, and availability may change as the Service develops. Any function shown as unavailable is not part of the Service until it is enabled in the interface.

You are responsible for your prompts, template selections, and other inputs, and for how you use generated images. The Service is not a substitute for professional legal, medical, financial, or other advice.

4. Credits, plans, and payments

Paid plans and one-time credit purchases are described on the pricing page and at checkout. Prices, credit allowances, validity periods, renewal terms, and included features are those displayed at the time of purchase. Unless the checkout states otherwise, subscriptions renew automatically for the selected billing period and may be canceled through the available account controls; cancellation stops future renewal but does not by itself refund the current period.

Credits have no cash value, are not transferable except as required by law, and may expire as described at purchase. The workspace may show an estimate before generation. The server-calculated quote at submission controls the credits charged. You authorize our payment provider to charge the applicable payment method and any taxes shown at checkout. Contact support if you believe a charge is incorrect.

5. Your content and permission to process it

You retain the rights you hold in text and other materials you submit ("User Content"), subject to the rights of third parties. You grant jevailab a limited, worldwide, non-exclusive license to host, reproduce, transmit, transform, and otherwise process User Content only as necessary to operate, secure, and improve the Service, comply with law, and provide the features you request. This permission ends when the relevant content is deleted from the Service, except for backups, records we must retain, or content already disclosed to a provider as part of a requested generation.

You represent that you have the rights and permissions needed to submit User Content and to request the resulting image. Do not submit content that infringes another person's rights.

6. Acceptable use

You must not use the Service to:

  • violate any applicable law or the rights of another person;
  • create or distribute illegal, fraudulent, abusive, harassing, hateful, discriminatory, or sexually exploitative content;
  • create, request, promote, glorify, threaten, or distribute violence, graphic injury, gore, torture, self-harm, or content that facilitates real-world harm;
  • create, request, upload, possess, distribute, solicit, facilitate, or sexualize child sexual abuse material (CSAM) or any sexual content involving a minor. jevailab has zero tolerance for CSAM;
  • create, request, distribute, advertise, or facilitate pornographic or sexually explicit content, sexual services, sexual solicitation, non-consensual intimate imagery, or sexual deepfakes;
  • facilitate human trafficking, child exploitation, non-consensual sexual content, or the exploitation of any person;
  • create, distribute, promote, recruit for, or glorify terrorist or violent extremist content, organizations, or acts;
  • impersonate a person or falsely suggest that an image is an authentic recording of a real event;
  • infringe copyright, trademark, privacy, publicity, or other rights;
  • attempt to identify, track, or harm another person without lawful justification;
  • create or facilitate illegal goods or services, including weapons, explosives, illegal drugs, dangerous chemicals, counterfeit or false identity documents, malware, phishing, credential theft, fraud, or deceptive schemes;
  • bypass safety systems, usage limits, access controls, or payment requirements;
  • upload malware, probe our systems, scrape the Service at scale, or interfere with its operation; or
  • resell, sublicense, or provide the Service to third parties except as expressly authorized by jevailab.

Reporting prohibited content

To report suspected prohibited content or activity, email support@jevailab.com with the subject line “Content Report,” or use our contact page. Please include enough detail for us to locate the material, such as a URL, screenshot, account or generation reference, date, and an explanation of the concern. We will acknowledge a report within two business days and complete an initial review and take appropriate action within five business days. During a review, we may preserve relevant records, seek additional information, limit access to the content or account, remove content, reject a generation request, or suspend or terminate an account. Credible reports of CSAM, non-consensual intimate imagery, or an imminent threat of real-world harm receive urgent priority: we will restrict access to the material and associated account within 24 hours of receipt, unless doing so is technically impossible or prohibited by law. We may report suspected illegal activity to providers or authorities where required by law.

7. Content review and enforcement

We and our providers may review prompts and generated results through automated or human-assisted systems to enforce these Terms and safety requirements. We may block a request, withhold an output, remove content, limit usage, or suspend an account when we reasonably believe content or activity creates a legal, security, or safety risk. Review does not guarantee that content is lawful or suitable for your intended use.

8. AI-generated images and limitations

AI systems can produce unexpected, inaccurate, biased, or similar-looking results. Generated images may not be unique and may resemble images produced for others. You must independently assess an image and its rights before publishing, selling, or otherwise using it. You are responsible for any disclosures required by applicable law or by the platform where you use the image.

9. Intellectual property

The Service, including its software, interface, branding, documentation, and published templates, is owned by jevailab or its licensors and is protected by intellectual-property laws. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable right to use the Service for its intended purpose.

As between you and jevailab, and subject to applicable law and third-party rights, you may use images you generate through your paid plan as permitted by the plan you purchased. We do not grant rights in third-party names, likenesses, trademarks, or other material that may appear in an image.

10. Third-party services

The Service relies on third-party model providers, hosting, storage, payment, email, security, and support providers. Their services may be subject to separate terms, may experience outages, and may change. jevailab is not responsible for third-party services outside its control, but we will use reasonable efforts to maintain the Service.

11. Suspension and termination

You may stop using the Service at any time and may delete your account where that control is available. We may suspend or terminate access if you materially breach these Terms, create a legal or security risk, fail to pay valid charges, or if we discontinue the Service. Where reasonably possible, we will give notice and an opportunity to address the issue. Provisions that by their nature should survive termination, including payment obligations, intellectual property, disclaimers, and liability limits, will continue to apply.

12. Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available." jevailab disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. We do not warrant that any generated image will be accurate, unique, lawful for your use, or meet your expectations.

13. Limitation of liability

To the maximum extent permitted by law, jevailab will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunity arising from the Service. Our aggregate liability arising out of or relating to the Service will not exceed the greater of the amount you paid to jevailab for the Service during the twelve months before the event giving rise to the claim or USD 100. These limits do not apply where liability cannot lawfully be limited.

14. Changes to these terms

We may update these Terms to reflect changes to the Service, law, or our practices. We will post the revised Terms with a new effective date and provide additional notice where required. Changes apply prospectively. If you do not agree to updated Terms, stop using the Service and cancel any subscription.

15. Contact

Questions about these Terms may be sent to support@jevailab.com or through our contact page.
